1. Acceptance of Terms
By accessing or using Go Bananas ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these terms.
2. User Accounts & Eligibility
You must be at least 13 years of age to use this Service. By creating an account, you represent that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Intellectual Property Rights
Platform Content: The Service itself — including the website, software, AI tooling, text, graphics, logos, icons, and branding, but excluding games and content created by users — is the property of Go Bananas and its licensors, protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your Content: You retain ownership of the games and other content you create or generate using the Service ("Your Content"), to the extent it is eligible for ownership under applicable law. By creating or publishing Your Content, you grant Go Bananas a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and make Your Content available through the Service — including in galleries, search results, and link previews, and (for published games) to allow other users to play and remix it as described in Section 4. This license exists solely to operate, improve, and promote the Service. It ends when you delete Your Content or your account, except for (a) copies retained in routine backups for a limited period and (b) remixes other users created while your game was published. You represent that you have the rights necessary to grant this license.
AI-generated output: Games are generated by AI from the prompts you provide. Because AI output may not be eligible for copyright in some jurisdictions, we make no representation that Your Content is protectable; the license and responsibilities above apply regardless.
Copyright complaints: If you believe content on the Service infringes your copyright, see our Copyright / DMCA Policy for how to submit a takedown notice.
4. Remix License
When you publish a game on Go Bananas, you grant other users the right to remix (fork) your game to create derivative works. Remixed games link back to your original and credit you as the original creator. You retain full ownership of your original game.
If you prefer not to allow remixing, keep your game as a draft (unpublished). Only published games can be remixed by other users.
5. AI-Generated Content & AI Assistants
Go Bananas creates games using AI based on the descriptions and prompts you provide. AI output can be inaccurate, incomplete, or unexpected, and similar prompts may produce similar results for different users. You are responsible for reviewing what you generate and for any content you choose to publish. We do not warrant that generated games are correct, original, fit for any particular purpose, or free of third-party rights.
Go Bananas can also be accessed through AI assistants (such as Claude) via the Model Context Protocol (MCP). When using Go Bananas through an AI assistant, the same Terms of Service apply, and games created that way are owned by you and subject to the same content guidelines as games created directly on the platform.
6. Prohibited Activities
You agree NOT to engage in any of the following prohibited activities:
- Copying others' content: You may not copy, reproduce, duplicate, redistribute, sell, or commercially use any games, game code, assets, or content that you do not own — including other users' games, AI-generated games created by others, and Platform Content — without authorization. (You may use Your own Content as described in Section 3, subject to the access rules below.)
- Scraping & Data Mining: You may not use any automated means, including robots, spiders, scrapers, or data-mining tools, to access, collect, harvest, or bulk-extract data, content, or information from the Service. Access Your own Content through the features the Service provides, not by scraping.
- Reverse Engineering: You may not decompile, disassemble, reverse engineer, or attempt to derive the source code, algorithms, or underlying ideas of the Service itself (this does not restrict your rights in Your own Content).
- Circumvention: You may not bypass, disable, or interfere with any security features, access controls, or usage limits of the Service.
- Impersonation: You may not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
- Malicious Content: You may not upload, transmit, or create any content that contains viruses, malware, or other harmful code.
7. Content Restrictions
You may not create, upload, or generate content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Contains sexually explicit material or promotes violence
- Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights
- Contains any advertising or promotional material without authorization
- Is designed to harm, exploit, or inappropriately interact with minors
8. Payments, Subscriptions & Tokens
Subscriptions and billing. Paid plans are billed through our payment processor, Stripe. Paid subscriptions renew automatically at the end of each billing period (monthly, or as stated at checkout) at the then-current price, until you cancel. By subscribing, you authorize us, through Stripe, to charge your payment method on a recurring basis.
Cancellation. You may cancel at any time from your account settings or by contacting support@gobananas.co. Cancellation stops future renewals; your paid access continues until the end of the current billing period. We do not provide prorated refunds for partial periods except where required by law.
Refunds. Except where required by applicable law, payments and tokens are non-refundable. If you believe you were charged in error, contact us within 30 days and we will review it in good faith.
Price changes. We may change subscription prices; changes apply to the next billing period after we give you reasonable notice.
Tokens. Tokens are a virtual in-app credit used to generate and edit games. They have no monetary value, cannot be exchanged for cash, are non-transferable, and may expire. We may modify the token system — including values, expiration, earning, and consumption — at any time. Tokens are consumed when you generate or edit games and are not restored for outputs you choose not to keep.
9. Enforcement & Termination
We reserve the right to:
- Remove or disable access to any content that violates these Terms
- Suspend or terminate accounts that violate these Terms
- Take legal action against users who violate these Terms, including seeking damages and injunctive relief
- Cooperate with law enforcement authorities in investigating violations
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO BANANAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify, defend, and hold harmless Go Bananas and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.
13. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes by posting a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
