Our policy

Go Bananas ("the Service") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. ยง 512, we respond to clear notices of alleged copyright infringement and remove or disable access to infringing user-generated or AI-generated content (including games, titles, descriptions, and uploaded assets such as images, audio, and 3D models). We also terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

Please use email for the fastest response. Only properly submitted infringement notices and counter-notices will be processed through this channel.

Filing a takedown notice (512(c)(3))

To be effective, your written notice must include substantially all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
  3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to let us locate it โ€” please include the game URL (e.g. https://gobananas.co/game/<id>) or asset URL.
  4. Your contact information (name, mailing address, telephone number, and email address).
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receipt of a valid notice, we will expeditiously remove or disable access to the identified material and make a good-faith effort to notify the user who posted it.

Counter-notice (512(g))

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to dmca@gobananas.co that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found), and that you will accept service of process from the complaining party.

If we receive a valid counter-notice, we may restore the removed material in 10โ€“14 business days unless the original complainant files a court action seeking to restrain the allegedly infringing activity.

Repeat infringers

We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

Misrepresentations (512(f))

Under Section 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please do not make false claims.
