Your continued use of the Service constitutes acceptance of any updates or modifications to these terms.
2. User Accounts & Eligibility
You must be at least 13 years of age to use this Service. By creating an account, you represent that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Intellectual Property Rights
Platform Content: All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, and compilation thereof, are the exclusive property of Go Bananas and its licensors, protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
User-Generated Games: Games created by users using our AI generation tools remain the intellectual property of Go Bananas. Users are granted a limited, non-exclusive, non-transferable license to play and share their created games within the platform only.
4. Prohibited Activities
You agree NOT to engage in any of the following prohibited activities:
- Copying or Reproduction: You may not copy, reproduce, duplicate, or make copies of any games, game code, assets, or content from the Service, whether created by the platform, other users, or AI-generated.
- Scraping & Data Mining: You may not use any automated means, including robots, spiders, scrapers, or data mining tools to access, collect, harvest, or extract any data, content, or information from the Service.
- Redistribution: You may not redistribute, republish, sell, license, rent, lease, transfer, or otherwise make available any games, content, or materials from the Service to any third party.
- Reverse Engineering: You may not decompile, disassemble, reverse engineer, or attempt to derive the source code, algorithms, or underlying ideas of any portion of the Service.
- Commercial Use: You may not use any content from the Service for commercial purposes without explicit written permission from Go Bananas.
- Circumvention: You may not bypass, disable, or interfere with any security features, access controls, or usage limits of the Service.
- Impersonation: You may not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
- Malicious Content: You may not upload, transmit, or create any content that contains viruses, malware, or other harmful code.
5. Content Restrictions
You may not create, upload, or generate content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Contains sexually explicit material or promotes violence
- Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights
- Contains any advertising or promotional material without authorization
- Is designed to harm, exploit, or inappropriately interact with minors
6. Token System & Virtual Currency
Tokens provided through the Service have no monetary value and cannot be exchanged for cash. Tokens are non-transferable and may expire. We reserve the right to modify the token system, including token values, expiration, and earning mechanisms, at any time without notice.
7. Privacy Policy
Information We Collect:
- Account Information: Email address (encrypted at rest), username, and password (hashed)
- Usage Data: Games played, session duration, interactions with the Service
- Device Information: IP address, browser type, device identifiers for security purposes
- Generated Content: Games and content you create using our tools (encrypted at rest)
How We Use Your Information:
- To provide, maintain, and improve the Service
- To process transactions and send related information
- To detect, prevent, and address fraud and security issues
- To communicate with you about the Service
- To enforce our Terms of Service
Data Retention:
- Account data: Retained while your account is active
- Security/fraud data: IP addresses, device fingerprints, and behavioral signals are automatically deleted after 90 days
- Payment records: Retained for 90 days for fraud prevention, then deleted
- Session tokens: Expire after 30 days (registered) or 14 days (anonymous)
Your Rights (GDPR):
- Right to Access: You can view your data in your account settings
- Right to Export: You can download all your data via account settings
- Right to Deletion: You can delete your account and all associated data at any time
- Right to Rectification: You can update your display name and account information
Third-Party Services: We share data with: Stripe (payments), SendGrid (emails), Anthropic (AI generation - prompts only, no personal data). Each service has its own privacy policy.
Data Security: We implement AES-256 encryption for sensitive data at rest, bcrypt for passwords, and TLS for data in transit. However, no method of transmission over the Internet is 100% secure.
8. Enforcement & Termination
We reserve the right to:
- Remove or disable access to any content that violates these Terms
- Suspend or terminate accounts that violate these Terms
- Take legal action against users who violate these Terms, including seeking damages and injunctive relief
- Cooperate with law enforcement authorities in investigating violations
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO BANANAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify, defend, and hold harmless Go Bananas and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.
